Mediation is a voluntary non-binding negotiation process facilitated by an impartial neutral mediator. The neutral helps the parties focus on the real issues involved in the dispute, and is skilled at helping the parties find a middle ground. Mediation is a very popular means of settling disputes and offers a way to avoid the time, costs, and risks involved in traditional litigation.
Arbitration is a dispute resolution procedure where parties agree to submit their disputes to an impartial neutral arbitrator or arbitrators. The arbitrator considers all arguments and evidence from all sides in a case and then renders a written final and binding decision. Prior to the arbitration the parties must agree on the neutral, and the rules to be used to govern the proceedings.
